General Terms and Conditions

1. Scope of Application

These General Terms and Conditions govern all contractual relationships between Autoverse Evers and its customers relating to the sale of used motor vehicles. They apply to all vehicle sales unless expressly agreed otherwise in writing.

Any terms and conditions of the buyer that differ from or contradict these Terms shall only apply if expressly accepted in writing by the seller.

2. Contract Conclusion

All vehicle offers, advertisements, online listings, and price indications are non-binding and subject to change.

A binding purchase contract is concluded only upon written agreement signed by both parties or upon vehicle handover combined with full or agreed payment of the purchase price. By concluding the contract, the buyer confirms that they have read and accepted these General Terms and Conditions.

3. Vehicle Condition and Description

The buyer acknowledges that the vehicle is a used vehicle. Signs of wear, age-related deterioration, and mileage-related characteristics are inherent to used vehicles and do not constitute defects.

Vehicle descriptions, images, technical data, and statements made in advertisements or on the website are provided for information purposes only and do not constitute guaranteed characteristics within the meaning of Art. 197 et seq. of the Swiss Code of Obligations (CO), unless expressly designated as binding in the written sales contract.

The buyer is encouraged to inspect the vehicle personally or have it inspected by a third party prior to purchase.

4. Purchase Price and Payment

The purchase price stated in the sales contract is binding. Unless otherwise agreed in writing, the full purchase price must be paid before or at the time of vehicle handover. Until full payment has been received, ownership of the vehicle remains with the seller in accordance with Art. 714 CO.

5. Transfer of Risk and Handover

Risk and responsibility for the vehicle transfer to the buyer upon physical handover, in accordance with Art. 185 CO. From the time of handover, the buyer bears all costs and obligations related to insurance, registration, taxes, fees, and operation of the vehicle.

6. Warranty and Defect Liability

The statutory warranty for defects is governed by Art. 197 to 210 of the Swiss Code of Obligations.

No warranty is granted by default. Any warranty, whether in scope or duration, depends on the specific vehicle and is agreed individually per vehicle. A warranty is only granted if it is explicitly stipulated in writing in the sales contract for the respective vehicle.

If a warranty is granted, its extent, duration, and covered components are defined exclusively in the individual agreement and may vary depending on the type, age, mileage, and condition of the vehicle.

In the absence of an expressly agreed warranty, the buyer’s rights are limited to the mandatory statutory provisions under Swiss law. The buyer must notify the seller of any defects immediately after discovery, in accordance with Art. 201 CO.

No liability exists for defects arising from normal wear and tear, improper use, accidents after handover, unauthorized modifications, or lack of maintenance.

7. Liability

The seller is liable only for damages caused by intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law.

Any liability for indirect damages, consequential damages, or loss of profit is excluded, unless mandatory statutory provisions apply.

8. Trade-In Vehicles

Trade-ins are possible and are assessed on a case-by-case basis. The valuation of a trade-in vehicle is based on its condition, mileage, service history, market value, and any known or hidden defects. The buyer warrants that all information provided regarding the trade-in vehicle is complete and accurate.

The trade-in value agreed upon forms part of the individual sales contract and does not constitute a general entitlement to a trade-in arrangement.

9. Data Protection

Personal data collected in the course of contract execution is processed in accordance with applicable Swiss data protection legislation, including the Federal Act on Data Protection (FADP). The data is used exclusively for contract execution, legal compliance, and administrative purposes.

10. Applicable Law and Jurisdiction

All legal relationships between the seller and the buyer are governed exclusively by Swiss substantive law, excluding conflict-of-law provisions. The place of jurisdiction is the registered place of business of the seller, insofar as permitted by law.

11. Severability

Should any provision of these General Terms and Conditions be invalid or unenforceable, the remaining provisions shall remain unaffected and fully valid.

12. Cookies

This Agreement shall begin on the date hereof.

Autoverse Evers does not filter, edit, publish or review Comments before their presence on the website. Comments do not reflect the views and opinions of Autoverse Evers, its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions.
